Welcome to AI Studio Plus! These Terms of Service ("Terms") govern your use of our platform, website, and services. By accessing or using AI Studio Plus, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using AI Studio Plus, you acknowledge that you have read, understood, and agree to be bound by:

• These Terms of Service
• Our Privacy Policy
• Any additional terms specific to certain features

2. Eligibility

To use AI Studio Plus, you must:

• Be at least 13 years old (or 16 in the EU)
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using our services under applicable laws
• Provide accurate and complete registration information

If you are under 18, you must have parental or guardian consent to use AI Studio Plus.

3. Account Registration and Security

3.1 Account Creation

• You may create an account using email/password or Google Sign-In
• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• One person or entity may not maintain more than one account without permission

3.2 Account Security

• You are responsible for all activities under your account
• Notify us immediately of any unauthorized access
• Use a strong, unique password
• Do not share your account with others

3.3 Account Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms
• Engage in fraudulent or illegal activities
• Abuse our services or harm other users
• Remain inactive for extended periods

4. Credits and Pricing

4.1 Credit System

• Credits are the virtual currency used to access paid features
• 1 Credit = $0.018 USD (approximately)
• Credits never expire and remain in your account until used
• Credits are non-transferable between accounts
• Chat is always FREE - no credits required for conversations

4.2 Purchasing Credits

• Credit packages available from $0.33 to $13.20
• All packages include a 9% bonus
• Payments processed securely through RevenueCat
• Prices subject to change with notice

4.3 Subscriptions

• Weekly Plan: $4.00/week
• Monthly Plan: $15.00/month
• Yearly Plan: $150.00/year
• Subscriptions provide unlimited generations (except upscales) plus bonus credits
• Auto-renewal unless cancelled before the next billing cycle
• Manage subscriptions through your device's subscription settings or RevenueCat

4.4 Free Trial and Bonuses

• Signup Bonus: 30 free credits for new users
• 3-Day Trial: Full access to all features
• Referrals: 30 credits for you and your friend
• Daily Check-In: Earn bonus credits
• Ad Rewards: 2 credits per ad watched

4.5 Refunds

• Refund requests handled through RevenueCat and your payment platform
• Generally, credits are non-refundable after purchase
• Unused credits from cancelled subscriptions are not refunded

5. Acceptable Use

5.1 Permitted Uses

You may use AI Studio Plus to:

• Generate creative content (images, videos, sound, text)
• Build and use AI agents for legitimate purposes
• Organize projects and manage your creations
• Collaborate and share content as permitted by the platform

5.2 Prohibited Uses

You must NOT use AI Studio Plus to:

• Illegal Activities: Generate content for illegal purposes or violate laws
• Harmful Content: Create content depicting violence, hate speech, harassment, or child exploitation
• Impersonation: Impersonate others or create deepfakes without consent
• Spam/Abuse: Send spam, phishing attempts, or abuse the platform
• Intellectual Property Violation: Infringe copyrights, trademarks, or other IP rights
• Privacy Violation: Generate content using others' personal information without consent
• Malicious Use: Create malware, viruses, or harmful software
• System Abuse: Attempt to hack, reverse engineer, or disrupt our services
• Scraping: Automated data collection or scraping without permission
• Reselling: Resell or redistribute our services without authorization

6. Content and Intellectual Property

6.1 Your Content

• You retain ownership of content you create using AI Studio Plus
• You grant us a license to store, display, and process your content to provide services
• Published agents and public content may be viewed by other users
• You are responsible for ensuring you have rights to any inputs (prompts, uploaded files)

6.2 AI-Generated Content

• AI-generated content is created by third-party AI models (OpenAI, Anthropic, Google, etc.)
• Subject to those providers' terms and policies
• You are responsible for verifying generated content doesn't infringe others' rights
• We do not claim ownership of AI-generated content
• Output may not be unique; similar prompts may produce similar results

6.3 Our Intellectual Property

• AI Studio Plus platform, code, design, and branding are our property
• You may not copy, modify, or create derivative works without permission
• Our trademarks and logos may not be used without authorization

7. Third-Party Services

AI Studio Plus integrates with third-party services:

• AI Providers: OpenAI, Anthropic (Claude), Google (Gemini), and others
• Payment Processing: RevenueCat, App Store, Google Play
• Infrastructure: Firebase, Google Cloud, AWS
• Analytics: Google Analytics, Firebase Analytics

These services have their own terms and privacy policies. We are not responsible for their actions or policies.

8. Availability and Support

8.1 Service Availability

• We strive for 99.9% uptime but do not guarantee uninterrupted access
• Scheduled maintenance may cause temporary downtime
• Features may be added, modified, or removed at our discretion

• Response times may vary based on subscription status

9. Disclaimers and Limitations

9.1 Service "As Is"

AI Studio Plus is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including:

• Merchantability or fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or quality of AI-generated content
• Freedom from errors, bugs, or viruses

9.2 AI Content Disclaimer

9.3 Limitation of Liability

To the fullest extent permitted by law, AI Studio Plus and its affiliates shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or errors
• Third-party actions or content
• Any damages exceeding the amount you paid us in the past 12 months

10. Indemnification

You agree to indemnify, defend, and hold harmless AI Studio Plus and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of any rights of others
• Content you create, upload, or share

11. Dispute Resolution

11.1 Informal Resolution

Before filing a claim, please contact us at legal@aisp.app to attempt informal resolution.

11.2 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

11.3 Class Action Waiver

You agree to bring claims only in your individual capacity, not as a class member in any class or representative proceeding.

12. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes via:

• Email to your registered address
• In-app notification
• Notice on our website

Continued use after changes constitutes acceptance of the new Terms.

13. Termination

13.1 By You

You may terminate your account at any time through Settings. Upon termination:

• Your data will be deleted within 30 days
• Unused credits are forfeited (non-refundable)
• Active subscriptions continue until the end of the billing period

13.2 By Us

We may terminate or suspend your account immediately for:

• Violation of these Terms
• Illegal activity
• Risk to other users or the platform
• Non-payment

14. General Provisions

14.1 Governing Law

These Terms are governed by the laws of the jurisdiction where AI Studio Plus is registered, without regard to conflict of law principles.

14.2 Severability

If any provision is found invalid or unenforceable, the remaining provisions continue in full effect.

14.3 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and AI Studio Plus.

14.4 Assignment

You may not assign these Terms without our consent. We may assign our rights and obligations to any party.

14.5 No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.
